Laws Governing Holidays in India

Before we peek into the segregation of Holiday List 2024, let’s see what laws govern the provision of holidays in India:

The Negotiable Instruments Act, 1881

The Negotiable Instruments Act, 1881, is a key piece of legislation in India that governs the use and transfer of negotiable instruments. Negotiable instruments are written documents that promise to pay a specific sum of money to the bearer or a specified person. The Act provides a legal framework for the regulation and protection of rights associated with negotiable instruments such as promissory notes, bills of exchange, and cheques. It is Section 25 of the N.I. Act, 1881 where the source of the power to declare holidays is mentioned.

The Weekly Holidays Act, 1942

The Weekly Holidays Act of 1942, enacted in India, is a piece of legislation that pertains to the regulation of weekly holidays for certain classes of people employed in industrial establishments. The primary objective of this act is to ensure that workers in certain industries are granted a mandatory day of rest each week.

The Industrial Employment (Standing Orders) Act, 1946

The Industrial Employment (Standing Orders) Act, 1946, is an Indian labor law that aims to regulate employment conditions in industrial establishments by defining and documenting the terms of employment.

The National and Festival Holidays Act, 1963

The National and Festival Holidays Act, 1963, aims to ensure that employees are granted time off to observe and celebrate national and religious festivals. It establishes a framework for the grant of holidays, compensation for work on holidays, and the role of the appropriate government in overseeing the implementation of the act. Employers are required to adhere to the provisions of this act to facilitate a harmonious work environment and acknowledge the cultural and religious diversity of the workforce.

The Companies Act, 2013

The Companies Act, 2013, is a dynamic and evolving legal framework that reflects contemporary business practices. It addresses various facets of corporate functioning, from incorporation to governance, and contributes to the development of a robust corporate ecosystem in India.

The Shops and Establishments Act, 1961

The Shops and Establishments Act, 1961 is a state-specific labor law in India that regulates the working conditions and terms of employment for employees working in shops, commercial establishments, and other businesses. This act is enacted by individual states and union territories, and its provisions may vary across different jurisdictions. Pertinently, the act prescribes the maximum number of working hours in a day and week, along with rules for spread-over and rest intervals. It outlines provisions for overtime work and compensation for employees working beyond regular hours. It states that employee is entitled to at least one weekly holiday, which is usually a day off in a week. Establishments must display a notice indicating the day of the week designated as the weekly holiday. Further, the act specifies provisions for leave, including annual leave with wages, sick leave, and casual leave. Also, it outlines the conditions under which employees become eligible for and can avail themselves of different types of leave.

The Factories Act, 1948

The Factories Act, 1948 is an Indian labor law that aims to regulate the conditions of work in factories to ensure the health, safety, and welfare of workers. It establishes standards for employment, hygiene, and occupational safety in industrial establishments. Further, it proclaims that workers are entitled to annual leave with wages based on the number of days worked during the previous calendar year. The act specifies the accumulation and utilization of leave.

Types of Government Holidays in India

In India, government holidays can be categorized into several types, including national holidays, state-specific holidays, and public holidays. Here are the main types:

1. Gazetted Holidays

In India, Gazetted Holidays refer to public holidays that are officially announced and published in the official government gazette. These holidays are declared by the government at the central or state level and are applicable across the respective jurisdiction.

National Holiday List 2025

India celebrates several national holidays that reflect its diverse cultural, historical, and religious heritage. The National & Festival Holidays Act mandates the provision of these three holidays to workers of all establishments in the country:

1. Republic Day (January 26th)

Celebrates the adoption of the Indian Constitution in 1950. The main event takes place in New Delhi with a grand parade showcasing India’s military strength, cultural diversity, and achievements.

2. Independence Day (August 15th)

Marks India’s independence from British rule in 1947. The Prime Minister hoists the national flag at the Red Fort in Delhi and addresses the nation.

3. Gandhi Jayanti (October 2nd)

Honors the birthday of Mahatma Gandhi, the Father of the Nation, known for his role in India’s non-violent struggle for independence. It is observed as the International Day of Non-Violence.

Bank Holiday List 2025

In India, bank holidays are designated days on which banks and financial institutions remain closed. These holidays can be categorized into three types:

1. National Holidays: These are observed nationwide and include occasions like Republic Day (26th January), Independence Day (15th August), and Gandhi Jayanti (2nd October). On these days, all banks across the country are closed.

2. State-specific Holidays: Each state in India may have additional holidays based on regional festivals, cultural events, or historical significance. These holidays vary from state to state, and banks in the respective states remain closed on these days.

3. Public Holidays: Apart from national and state-specific holidays, there are public holidays such as Holi, Diwali, Eid, Christmas, etc.

Do note that banks all over India remain closed on the second and fourth Saturday of every month. This is a measure aimed at providing banking staff with regular weekends off and improving work-life balance. 

Previously, Saturdays used to be half-days for banks. However, as per the Reserve Bank of India Guidelines, effective from September 1, 2015- the second and fourth Saturdays of each month have been declared to be complete days-off. Therefore, all the commercial, regional, rural, scheduled, and non-scheduled banks in India remain closed on the second and fourth Saturdays of each month.
